Florida has a "zero tolerance" policy
for drinking and driving involving young
people under the legal drinking age of
21. While the legal limit for adults is
.08%, the limit for underage drivers is
0.02%. This means that even one drink
can put the underage driver over the
legal limit.
If a law enforcement officer has reason
to believe that the underage driver
meets or exceeds the .02 alcohol level,
the officer may detain the underage DUI
offender. The officer may request
administration of appropriate breath
tests, blood and urine tests or other

suspension of driver's license.
First-time offenders face a 6-month

education courses. The completion of a

with a BAC of 0.05% or above. Underage

penalties associated with standard DUI
charges if they exceed the .08 BAC level
or are convicted of other related DUI
charges such as DUI with Personal
Injury.
There are also indirect consequences of
an underage DUI conviction that must be
considered. Insurance premiums will
increase for up to 3 years, the DUI
conviction can limit the young person's
future employment prospects, high school
and college students may also face
disciplinary actions, and the license
suspension can make it difficult to keep
a job or attend school.
